Terms and Conditions of Equipment Hire

1. Definitions
Supplier: Cleets Pty Ltd.
Hirer: The entity hiring equipment from Cleets.
Equipment: Geotechnical testing instruments and accessories listed in the hire agreement or invoice.
Hire Agreement: A written or digital confirmation of the equipment, duration, rates, and bond applicable to the hire.
Bond: A refundable amount held as security against loss, damage, or breach of hire terms.
2. Governing Terms & Conditions
These terms apply to all equipment hire agreements unless otherwise agreed in writing by Cleets. By submitting a hire request, the Hirer agrees to be bound by these terms.
3. Hire Period
The hire period begins on the date of equipment pickup or delivery and ends when the equipment is returned and accepted by Cleets.
Extensions must be requested in writing before the end date and are subject to availability and additional charges.
Late returns may incur additional daily charges and may void any pre-agreed rates.
4. Bond & Payment
A bond must be paid in full prior to dispatch unless Cleets agrees otherwise.
Hire charges must be paid in advance unless agreed under separate account terms.
The bond will be refunded within 7 business days of safe return and inspection of the equipment, minus any deductions for damages, cleaning, or late fees.
5. Delivery & Return
Cleets offers delivery Australia-wide. Fees will be confirmed prior to dispatch.
The Hirer is responsible for return of equipment by the agreed date.
Equipment must be returned clean, complete, and in working condition.
Hirers must notify Cleets if return will be delayed — unnotified delays may result in penalties.
6. Responsibility for Equipment
Risk transfers to the Hirer upon delivery or collection.
The Hirer is liable for any loss, theft, or damage during the hire period.
Equipment must not be altered, repaired, or tampered with by the Hirer unless authorised by Cleets.
Cleets reserves the right to charge for cleaning, repair, or full replacement if equipment is returned in unsatisfactory condition.
7. Inspection & Acceptance
The Hirer must inspect all equipment upon receipt and notify Cleets within 24 hours of any faults.
Use of the equipment is deemed acceptance that it is fit for the intended purpose.
8. Use & Limitations
Equipment must be used only for its intended geotechnical or materials testing applications and in accordance with relevant standards and manufacturer guidance.
Hirers must ensure all users are trained and competent.
Equipment must not be moved outside of the agreed project location without Cleets’ consent.
9. Indemnity & Insurance
The Hirer indemnifies Cleets against all claims, damages, or losses arising from use, misuse, or failure of the equipment during the hire period.
Hirers are responsible for ensuring adequate site safety, equipment handling, and (where necessary) insurance coverage during the hire period.
10. Ownership
All equipment remains the property of Cleets Pty Ltd at all times.
The Hirer shall not sell, assign, mortgage, or otherwise encumber the equipment.
11. Force Majeure
Cleets is not liable for failure to deliver or fulfil obligations due to events beyond its control, including natural disasters, transport delays, or supplier interruptions.
12. Cancellation
Hire bookings cancelled less than 48 hours before the dispatch date may incur a cancellation fee.
Cancellations after dispatch will be charged a minimum of one full day’s hire plus freight.
13. Disputes & Jurisdiction
These terms are governed by the laws of the relevant state or territory in which the hire is agreed.
Disputes will be resolved in the jurisdiction where the Hire Agreement was accepted.
